The agreement between the user of Sheria Smart and Sheria Smart. Effective 14 May 2026.
These Terms of Use (the "Terms") govern your use of Sheria Smart, accessible at sheriasmart.com and app.sheriasmart.com, including all related features, content and services (the "Platform"). By using the Platform you confirm that you have read these Terms, the Privacy Notice, and any additional terms applicable to paid features, and that you agree to be bound by them. If you do not agree, please do not use the Platform.
In these Terms, the following expressions have the following meanings.
"Advocate" means a person admitted to the Roll of Advocates of the High Court of Kenya and holding a current practising certificate under the Advocates Act, Cap. 16 of the Laws of Kenya.
"AI Output" means any content generated by LexAI in response to a User Input.
"LexAI" means the artificial intelligence assistant integrated into the Platform.
"User Input" means any prompt, query or material a User submits through the Platform.
"User" means any natural person who accesses or uses the Platform.
To register for an account, you must be at least 18 years old and have the legal capacity to enter into a contract. By using the Platform you confirm that this is so.
Sheria Smart is a legal information and self help platform. It provides plain language explanations of Kenyan law, structured templates, and guided workflows for forums in which Kenyan law permits a party to appear in person, including in particular the Small Claims Court established under Section 4 of the Small Claims Court Act, No. 2 of 2016, where Section 20 of that Act permits a party to appear in person.
The Platform is not a law firm. It is not on the Roll of Advocates of the High Court of Kenya. It holds no practising certificate. Nothing on the Platform is legal advice. Use of the Platform does not create an advocate client relationship between you and Sheria Smart, and communications through the Platform are not protected by advocate client privilege.
The Platform does not draft, prepare or take instructions for any document falling within Section 34(1) of the Advocates Act, Cap. 16. For legal advice on your specific matter, please consult a qualified advocate. You can verify any advocate's status at lsk.or.ke.
Where you produce any document through a template or guided workflow on the Platform, you are the author of that document. You key in every substantive answer. You are responsible for the accuracy of every statement in the document, for the lawfulness of every claim or defence in it, for verifying that the document complies with the applicable procedural rules including the Small Claims Court Rules, 2019 (Legal Notice No. 145 of 2019), and for signing and filing the document personally.
LexAI is powered by artificial intelligence. AI Output is generated probabilistically and may be wrong, incomplete, or out of date. You must independently verify any AI Output against primary sources, including kenyalaw.org, before relying on it. AI Output is not legal advice.
You agree to use the Platform lawfully and respectfully. You will not use the Platform for any unlawful purpose, to infringe the rights of others, to harass any person, to scrape or extract content other than as the Platform permits, to circumvent any rate limit or security measure, to impersonate any person, to upload malicious code, or to misuse LexAI to produce harmful or unlawful material.
The Platform, its trade marks (including the marks "Sheria Smart" and "LexAI"), its editorial content, templates, software, designs and other proprietary materials are the property of Sheria Smart and its licensors. You are granted a limited, personal, non commercial licence to use the Platform during the term of these Terms.
You retain ownership of your User Input. You grant us a licence to host, store, transmit and display the User Input solely to the extent necessary to operate the Platform and respond to your request.
As between you and Sheria Smart, we assign to you any rights we may have in the AI Output generated in response to your User Input, on the condition that you remain responsible for verifying its accuracy before relying on it.
Paid features are offered on subscription or pay as you go terms. The applicable price, billing cycle and any free trial terms are displayed at the point of purchase, in accordance with the disclosure requirements of the Consumer Protection Act, Cap. 501 of the Laws of Kenya.
Subscriptions renew automatically at the end of each billing cycle until cancelled. You may cancel through your account settings or by emailing support@sheriasmart.com; cancellation takes effect at the end of the then current billing cycle. Payments are non refundable once the relevant billing cycle has commenced, save where the law requires otherwise or where the relevant feature has not been delivered through a fault on our part.
The Platform is provided as is and as available, without warranties of any kind beyond those imposed by law.
To the maximum extent permitted by law, our total liability to you in connection with the Platform, however arising, shall not exceed the greater of (a) the fees paid by you to Sheria Smart in the three months preceding the event giving rise to the claim, or (b) Kenya Shillings five thousand (KES 5,000). Nothing in these Terms limits any liability that cannot lawfully be limited.
If you are arrested or detained, contact a qualified advocate immediately. If you cannot afford one, the National Legal Aid Service (toll free 0800 720 640) may assist. Under Article 50(2)(h) of the Constitution of Kenya, 2010, the State may assign an advocate at its own expense where substantial injustice would otherwise result. The Platform cannot be used to track legal deadlines on your behalf. Limitation periods and filing deadlines are strict; if a deadline is approaching, consult an advocate without delay. In a genuine emergency, call 999 or 112.
You may stop using the Platform and close your account at any time. We may suspend or close any account at our discretion, including where there has been a breach of these Terms, where required by law, or where we discontinue the Platform or any feature of it. Clauses that by their nature should survive (including Clauses 4, 6, 8, 10, 11 and 15) shall survive.
Personal data is processed in accordance with the Privacy Notice published at sheriasmart.com/privacy and in compliance with the Data Protection Act, Cap. 411C of the Laws of Kenya and the Data Protection (General) Regulations, 2021. You may exercise your rights as a data subject by writing to support@sheriasmart.com.
If a dispute arises, please first contact us at support@sheriasmart.com with a description of the matter and the outcome you are seeking. We will try in good faith to resolve it within thirty days. Any dispute that cannot be resolved through good faith discussion shall be determined by a court of competent jurisdiction.
Changes to these Terms. We may update these Terms from time to time. We will give reasonable notice of material changes. Your continued use of the Platform after the change takes effect amounts to acceptance.
Severability. If any provision of these Terms is held unenforceable, the remainder shall continue in effect.
No waiver. A delay in exercising any right under these Terms does not waive that right.
Beyond reasonable control. Neither party shall be liable for any failure or delay caused by events beyond reasonable control.
Assignment. You may not transfer these Terms without our consent. We may transfer them in connection with a reorganisation or sale of our business.
Entire agreement. These Terms, together with the Privacy Notice, are the entire agreement between you and Sheria Smart in respect of the Platform.
Notices. Notices to us should be sent to support@sheriasmart.com. Notices to you will be sent to the email address associated with your account.
Language. These Terms are made in English. Any translation is for convenience only.
Effective date: 22 May 2026. These Terms supersede any prior terms of use published on this platform.
